The rules governing pharmacy benefit managers (PBMs) are changing rapidly, but the impact extends far beyond PBMs themselves. Brokers, consultants, TPAs, and plan sponsors are facing a wave of new transparency, disclosure, and fiduciary oversight requirements that could significantly alter how pharmacy benefits are procured, monitored, and managed.

New Department of Labor (DOL) disclosure requirements, the pharmacy benefit manager reforms enacted as part of the Consolidated Appropriations Act of 2026 (CAA 2026), and a growing body of litigation are creating increased prohibited transaction, fiduciary, and conflict-of-interest risks across the industry.
